Terms of Service

1. Scope

These Terms of Service apply to the use of the ProductPolish platform (hereinafter "Service"), operated by GPS Konzept e.U., Birkengasse 5, 3442 Asparn, Austria (hereinafter "Operator"). By registering, you accept these terms.

Deviating terms of the user are only recognised if the Operator has expressly agreed to them in writing.

2. Service Description

ProductPolish provides an AI-powered platform for creating SEO-optimised product texts and AI-generated product images for e-commerce businesses. The scope of services depends on the chosen subscription plan.

Note: All texts and images created by ProductPolish are generated using artificial intelligence. Generated content should be reviewed before publication. The Operator does not guarantee the accuracy, completeness or suitability of AI-generated content.

3. Registration and Account

Registration is required to use the Service. You are obliged to provide accurate information and to keep your password confidential. You are liable for all activities that take place under your account.

4. Subscription Plans and Prices

The Service is offered in various subscription plans (Starter, Pro, Business). Current prices and features are available on the pricing page. All prices include applicable VAT.

The Operator reserves the right to change prices with 30 days' notice. Price changes only apply from the next billing period.

5. Payment Terms

Subscription fees are billed monthly in advance via our payment provider Stripe (Stripe Inc., USA). By taking out a subscription, you consent to recurring charges.

The subscription automatically renews by one month unless cancelled before the end of the current billing period.

6. Usage Rights

Texts and images generated by the Service may be used for commercial purposes. ProductPolish does not claim ownership of generated content. However, you are solely responsible for ensuring that use of the content does not infringe third-party rights.

7. Right of Withdrawal

Consumers have a statutory right of withdrawal of 14 days under the Distance and Off-Premises Contracts Act (FAGG). The complete withdrawal notice and the model withdrawal form can be found on our Withdrawal Notice page.

8. Availability

ProductPolish strives for high availability of the Service but cannot guarantee uninterrupted access. Maintenance work will be announced in advance where possible.

9. Warranty

The statutory warranty provisions of Austrian law apply. For consumers within the meaning of the Consumer Protection Act (KSchG), statutory warranty rights cannot be restricted or excluded.

10. Limitation of Liability

ProductPolish is not liable for the accuracy of AI-generated texts and images. Use of generated content is at your own risk.

The Operator's liability is — to the extent permitted by law — limited to the monthly subscription amount. Liability for personal injury and in cases of intent and gross negligence remains unaffected (KSchG §6).

11. Data Protection

Personal data is processed in accordance with our Privacy Policy and applicable data protection laws (GDPR, DSG). Uploaded product photos are used solely for generation and are not passed on to unauthorised third parties.

12. Cancellation

Cancellation is possible at any time at the end of the current billing period. Cancellations can be made via account settings or by email at support@productpolish.ai.

In the event of a breach of these terms, ProductPolish reserves the right to block access immediately. Already billed periods will not be refunded in such cases if the breach is attributable to the user.

13. Applicable Law and Jurisdiction

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers within the meaning of the KSchG, the place of jurisdiction is their domicile, habitual residence or place of employment (KSchG §14).

15. Severability Clause

Should individual provisions of these Terms be invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.

16. Amendments

ProductPolish reserves the right to amend these Terms at any time. You will be notified of significant changes at least 30 days in advance by email. Continued use after expiry of the notice period constitutes acceptance. You have the right to terminate with immediate effect in case of objection.
